These Terms & Conditions ("Terms") govern your access to and use of the SetStar mobile application ("App") and the website setstar.app ("Website"), owned and operated by Obenyx Ltd ("we," "our," "us," or "Company").

By downloading, installing, accessing, or using SetStar, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

We may update these Terms from time to time. Material changes will be notified in the App. Continued use after changes constitutes acceptance.

2. Ownership and Service Description

2.1 Ownership

SetStar, the setstar.app website, and all related services are owned and operated by Obenyx Ltd, a company incorporated in [England & Wales]. All rights, title, and interest in and to the App and Website, including intellectual property, remain the property of Obenyx Ltd.

2.2 Service Description

SetStar is a mobile fitness application that enables users to:

• Track workout exercises, sets, reps, and weights

• Monitor fitness progress and performance metrics

• Set and track fitness goals and achievements

• Visualize progress through charts and statistics

• Store and sync workout data across devices

• Export workout data

The App is provided for informational and tracking purposes only and is not intended as medical or professional fitness advice.

3. Eligibility

You must be at least 13 years of age to use SetStar. By using the App, you represent and warrant that:

• You are at least 13 years old

• You have the legal capacity to enter into these Terms

• You will comply with all applicable laws and regulations

• All information you provide is accurate and current

If you are under 18, you represent that you have obtained parental or guardian consent to use the App and agree to these Terms.

4. Account Registration and Security

4.1 Account Creation

To access certain features, you must create an account by providing:

• A valid email address

• A secure password

• Additional profile information (optional)

You are responsible for:

• Maintaining the confidentiality of your account credentials

• All activities that occur under your account

• Notifying us immediately of any unauthorised use

4.2 Account Security

We use Firebase Authentication for secure account management. You agree not to:

• Share your account credentials with any third party

• Use another user's account

• Attempt to gain unauthorised access to the App or its systems

5. Subscriptions and Payment Terms

5.1 Subscription Plans

SetStar offers premium subscription plans:

• Monthly Subscription: £5.99 per month

• Annual Subscription: £35.99 per year (equivalent to approximately £2.99 per month, representing a 50% discount compared to monthly billing)

Subscription plans provide access to SetStar Premium features, including full workout tracking, progress visualization, goal setting, achievements, and cloud data synchronization.

5.2 Free Trial

New users may receive a free 7-day trial of SetStar Premium ("Trial Period"). The Trial Period:

• Begins when you first access the App or when you choose to start the trial

• May be extended by an additional 3 days at our discretion (maximum 10 days total)

• Is available once per user account

• Provides full access to Premium features during the Trial Period

At the end of the Trial Period, if you have not cancelled, your subscription will automatically convert to a paid subscription and you will be charged according to your selected plan.

5.3 Payment Processing

All subscription payments are processed through the Apple App Store via Apple's in-app purchase system. Obenyx Ltd does not directly process payments or store payment information. By purchasing a subscription, you agree to:

5.4 Subscription Management Service

SetStar uses RevenueCat, a third-party subscription management service, to:

• Verify your subscription status

• Manage subscription entitlements

• Sync subscription status across devices

RevenueCat acts as an intermediary between your Apple App Store subscription and the App. Your subscription data may be processed by RevenueCat in accordance with their Privacy Policy: https://www.revenuecat.com/privacy

5.5 Billing and Auto-Renewal

Automatic Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You will be charged the applicable subscription fee to your Apple ID account at confirmation of purchase and at the start of each renewal period.

Billing Cycle:

• Monthly subscriptions renew every month

• Annual subscriptions renew every year

• Renewal occurs on the same day of the month/year as your original purchase

Price Changes: We reserve the right to change subscription prices at any time. We will provide reasonable notice of price changes, and such changes will apply to your next billing cycle unless you cancel your subscription before the change takes effect.

Currency: All prices are displayed in British Pounds (GBP). Actual charges may vary based on your location and local currency, as determined by Apple.

5.6 Cancellation and Refunds

Cancellation: You may cancel your subscription at any time through:

• The App's Settings section, which will direct you to Apple's subscription management page

• Your Apple App Store account settings: https://apps.apple.com/account/subscriptions

Effect of Cancellation:

• Cancellation takes effect at the end of your current billing period

• You will continue to have access to Premium features until the end of the paid period

• No refunds will be provided for the unused portion of the current billing period

• Your account will revert to free/trial access limitations after the paid period expires

Refunds: Refund requests must be submitted directly to Apple through their refund process. Apple's refund policy governs all refund requests. We are not responsible for processing refunds, as payments are handled entirely by Apple.

5.7 Trial Cancellation

You may cancel your subscription at any time during the Trial Period to avoid being charged. If you cancel before the Trial Period ends, you will not be charged, and your access to Premium features will end at the conclusion of the Trial Period.

5.8 Restore Purchases

If you have previously purchased a subscription, you may restore your purchases through the App's Settings section. This will restore your subscription status if you have reinstalled the App or are using it on a different device.

5.9 Subscription Status and Access

Subscription status is verified through RevenueCat and Apple's systems. In the event of a discrepancy or system error, please contact us for assistance. We reserve the right to:

• Suspend or terminate subscriptions if we detect fraudulent activity

• Limit access if payment cannot be processed

• Modify or discontinue subscription plans with reasonable notice

6. User Responsibilities and Acceptable Use

6.1 Acceptable Use

You agree to use SetStar only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations

• Infringe upon the rights of others

• Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, or objectionable

• Attempt to gain unauthorised access to the App, servers, or networks

• Interfere with or disrupt the App or servers

• Use automated systems (bots, scrapers) to access the App without permission

• Reverse engineer, decompile, or disassemble any part of the App

• Remove or alter any proprietary notices or labels

6.2 User Content and Data

You retain ownership of all workout data, exercises, and personal information you enter into the App ("User Content"). By using SetStar, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

• Store and process your User Content to provide the service

• Sync your User Content across your devices

• Back up your User Content in our cloud storage systems (Firebase)

• Use aggregated, anonymized data for service improvement

You are solely responsible for:

• The accuracy and completeness of your User Content

• Ensuring you have the right to input any User Content

• Backing up important data (we provide export functionality for this purpose)

6.3 Data Export

You may export your workout data as a PDF document through the App's Settings section. We encourage you to regularly export and backup your data.

7. Health and Safety Disclaimer

IMPORTANT: READ THIS SECTION CAREFULLY

SetStar is a fitness tracking application designed to help you monitor your workouts and progress. The App is provided for informational and tracking purposes only and is not intended as a substitute for professional medical advice, diagnosis, or treatment.

Health and Safety Warnings:

• Consult with a qualified healthcare provider or fitness professional before beginning any new exercise program

• The App does not provide medical, fitness, or health advice

• We are not responsible for any injuries or health issues that may arise from your use of the App or following any workout plans

• Always warm up before exercising and cool down afterward

• Stop exercising immediately if you experience pain, dizziness, shortness of breath, or any other unusual symptoms

• Listen to your body and do not exceed your physical limitations

• The App's recommendations, if any, are suggestions only and may not be appropriate for your individual circumstances

Assumption of Risk:

By using SetStar, you acknowledge and agree that:

• Exercise and physical activity carry inherent risks of injury

• You assume all risks associated with any exercise or physical activity you undertake

• You will use the App at your own risk

• We shall not be liable for any injury, loss, or damage resulting from your use of the App or any exercise or physical activity

Medical Clearance:

If you have any medical conditions, injuries, or concerns, consult with your healthcare provider before using the App or engaging in any exercise program. The App is not suitable for individuals with certain medical conditions, and we recommend professional medical clearance before beginning any fitness program.

8. Data Storage and Cloud Services

8.1 Local and Cloud Storage

SetStar stores your data both locally on your device and in cloud storage:

• Local Storage: Data is stored locally using iOS UserDefaults to enable offline functionality and fast access

• Cloud Storage: When you create an account, your data is automatically synced to Firebase Firestore, Google's cloud database service

8.2 Data Synchronization

Data synchronization allows you to:

• Access your workout data across multiple devices

• Recover your data if you uninstall and reinstall the App

• Maintain backups of your information

By using cloud storage, you acknowledge that:

• Your data will be stored on servers operated by Google (Firebase)

• Data transfer occurs over the internet

• We use industry-standard security measures, but cannot guarantee absolute security

8.3 Third-Party Services

SetStar uses the following third-party services that may access your data:

• Firebase (Google): For authentication, cloud storage, analytics, and crash reporting

• RevenueCat: For subscription management and verification

• Apple: For payment processing and app distribution

These services have their own terms of service and privacy policies, which govern their use of your data.

9. Intellectual Property Rights

9.1 Our Intellectual Property

All content, features, and functionality of SetStar, including but not limited to:

• The App's design, layout, graphics, and user interface

• Software code, algorithms, and technical implementation

• Trademarks, logos, and brand names

• Documentation and help materials

are owned by Obenyx Ltd or its licensors and are protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your iOS device(s)

• Use the App for your personal, non-commercial use

• Access and use your User Content

This license does not permit you to:

• Copy, modify, or create derivative works of the App

• Redistribute, sublicense, or transfer the App

• Use the App for commercial purposes

• Remove or alter any copyright, trademark, or proprietary notices

9.3 User Content License

You retain ownership of your User Content but grant us the license specified in Section 6.2 above.

10. Privacy

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using SetStar, you consent to our Privacy Policy.

• Technical issues or server problems

• Circumstances beyond our reasonable control

11.2 Service Modifications

We reserve the right to:

• Modify, update, or discontinue any features or functionality

• Change subscription plans, pricing, or trial terms (with notice)

• Add, remove, or modify third-party integrations

• Discontinue the App or any portion thereof (with reasonable notice)

We will provide reasonable notice of material changes that adversely affect your use of the App.

12. Disclaimers and Limitation of Liability

12.1 Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY

• FITNESS FOR A PARTICULAR PURPOSE

• NON-INFRINGEMENT

• ACCURACY OR RELIABILITY OF INFORMATION

• UNINTERRUPTED OR ERROR-FREE OPERATION

We do not warrant that:

• The App will meet your requirements

• The App will be available at all times

• Any errors or defects will be corrected

• The App is free of viruses or harmful components

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OBENYX LTD SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

• LOSS OF PROFITS, REVENUE, DATA, OR USE

• PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE APP

• ANY DAMAGES RESULTING FROM:

• YOUR INABILITY TO USE THE APP

• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA

• ERRORS OR OMISSIONS IN THE APP

• THIRD-PARTY CONDUCT OR CONTENT

• ACTIONS TAKEN IN RESPONSE TO YOUR USE OF THE APP

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SUBSCRIPTIONS IN THE 12 MONTHS PRECEDING THE CLAIM, OR £50, WHICHEVER IS GREATER.

12.3 Exceptions

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence

• Fraud or fraudulent misrepresentation

• Any other liability that cannot be excluded or limited under applicable law

13. Indemnification

You agree to indemnify, defend, and hold harmless Obenyx Ltd, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorney's fees) arising from:

• Your use of or access to SetStar

• Your violation of these Terms

• Your violation of any third-party rights

• Any content you submit, post, or transmit through the App

• Your violation of any applicable laws or regulations

14. Termination

14.1 Termination by You

You may stop using SetStar at any time by:

• Uninstalling the App from your device

• Cancelling your subscription (if applicable)

• Deleting your account through the App's Settings

14.2 Termination by Us

We may suspend or terminate your access to SetStar immediately, without prior notice, if:

• You violate these Terms

• You engage in fraudulent, abusive, or illegal activity

• We are required to do so by law

• We discontinue the App or any portion thereof

• You fail to pay subscription fees when due

14.3 Effect of Termination

Upon termination:

• Your right to use SetStar immediately ceases

• We may delete your account and data, subject to our data retention policies

• You remain responsible for all fees incurred before termination

• Provisions that by their nature should survive termination will remain in effect

14.4 Data After Termination

We will retain your data for a reasonable period after termination, after which it may be permanently deleted. You are responsible for exporting your data before termination if you wish to retain it.

15. Third-Party Services and Links

SetStar integrates with and uses various third-party services, including:

• Apple App Store: For app distribution and payment processing

• Firebase (Google): For authentication, cloud storage, and analytics

• RevenueCat: For subscription management

These third-party services have their own terms of service and privacy policies. We are not responsible for:

• The availability, accuracy, or practices of third-party services

• Any loss or damage resulting from your use of third-party services

You are responsible for reviewing and accepting the terms and policies of any third-party services you use.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

16.2 Jurisdiction

Any disputes arising out of or relating to these Terms or SetStar shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16.3 Alternative Dispute Resolution

Before initiating formal legal proceedings, you agree to first contact us to seek an amicable resolution. If a dispute cannot be resolved amicably within 30 days, you may pursue formal legal action.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Obenyx Ltd regarding your use of SetStar and supersede all prior agreements and understandings.

17.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

17.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign or transfer these Terms or our rights and obligations without restriction.

17.5 Notices

We may provide notices to you through:

• Email to the address associated with your account

• Posting on our website

17.6 Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, or internet or telecommunications failures.
